A high-profile incitement case has been neglected by senior hierarchy of the main opposition All Peoples Congress (APC) Party, who have turned blind eyes and deaf ears on the welfare of one Brima Conteh AKA Mubaza, a popular Electoral Justice Advocate and a member of the APC Party, who has been on remand at the Pademba Road Correctional Center for a video of him which was circulated on social media in which he claimed that some ex- US military officers are in Sierra Leone to monitor the movement of President Julius Maada Bio.
In an interview with the press after the adjournment of the matter on Wednesday 17th December 2025, at the Freetown Magistrate Court Number 1, presided over by Magistrate Mustapha Brima-Jah, lead defense lawyer, Abdul Malik Bangura ESQ said his team has made applications to the court for a bail with has been consistently denied, and said that the accused is currently serious sick in custody and may die if swift actions are not taken.
Lawyer Abdul Malik confirmed that before the court is a medical report dated 1st December 2025 from the Director of Medical Service of the Sierra Leone Police which says that his client has been diagnosed in custody with malignant hypertension, hypertensive heart disease, hyperlipidemia and pansinusitis which required him to be reviewed by a cardiologist and have regular professional health checks. Despite numerous pleas for the accused to be granted bail on medical grounds, that has been denied. He has been in custody both at the police and in prison since 10th November 2025 and has not been able to get specialist medical since then.
When asked whether he considered the consistent denial of accused bail as a result of political interference, Lawyer Abdul Malik Bangura said the offence of which the accused is charged for is a bail able offence. He said bail is at the discretion of the magistrate, but when the facts are clear, particularly on medical grounds that is a clear condition for bail. He said that he feels that “human rights are fundamental and there is sanctity to their protections. Judges and magistrates are supposed to be the arbiters of justice and should never be influenced when the facts are clear for them to act in a given situation. We have a case and we have an accused person critically ill in detention. We are still pleading with the magistrate to grant bail, but if there are other factors mitigating against our efforts despite the facts are so clear for him to grant bail, then our duty as lawyers is to just respect the decision of the bench.”
Dilating further, Lawyer Abdul Malik Bangura confirmed that the accused had infact been sick throughout the police investigation stage. “Since his arrest in Magburaka on 10th November, our client has been admitted,” Lawyer Abdul Malik Bangura confirmed that, Mr Conteh spent 2 weeks at the police hospital in Kingtom before he was brought from the police hospital straight to the Pademba Road Correctional Centre where his health has since deteriorated drastically. All expenses had been handled by the accused and his family.
When asked about the neglect of his client by the APC leadership and the leadership of the Electoral Justice Movement, Lawyer Bangura said he is a lawyer and will speak on the legal and psychological dynamics of the matter. He said, psychologically, the accused because of his diagnosed heart condition needs the support of everyone. This is why he has been resilient and remain optimistic that Mr Conteh is granted bail at least so he can seek professional cardiologist, and if not he is afraid the accused might die in custody of heart complications, which he feel will not be good for the justice sector of Sierra Leone.
The accused, Brima Conteh faces one count indictment of Incitement Contrary to law at the Freetown Pademba Road Magistrate Court Number One presided over by Magistrate Mustapha Brima-Jah. The matter was adjourned again to Friday 19th December 2025.
